General Terms of Transport

1. APPLICATION OF THESE CONDITIONS


1.1 The conditions of carriage apply to the transport of passengers by Transport Phoenix  in accordance with the provisions of EU Regulation n. 181 of 16 February 2011. Vehicles are used for the transport of passengers.
1.2 If the service is provided by commercial partners (hereinafter also: " Partners "), their general contractual conditions and specific conditions of carriage apply exclusively. These are available on the Partners' websites. Please note that they may only be available in English. Partners assume no obligation for transport using the Transport Phoenix brand.

2. RIGHT TO TRANSPORT


2.1 The right to transport exists to the extent that a transport contract has been concluded.
2.2 Booking confirmation entitles the passenger to travel from the place of departure to the destination indicated on the ticket. Subsequent boarding or early disembarking of passengers is prohibited by law.
2.3 In the case of bookings made on board the vehicle, the obligation to transport exists only if sufficient seats are available for the entire journey.
2.4 In the case of stops on request, the obligation to transport exists only if the trip was booked to or from that stop within the corresponding booking period. Request stops are marked as such on the relevant itinerary.

3. TICKETS, TRANSPORT FARES


3.1 Fixed transport fares must be paid. In this regard, Transport Phoenix issues tickets. Booking confirmation, in paper or electronic format (PDF) accompanied by a valid photo ID, constitutes a ticket. If a booking is made on board, the receipt serves as proof of purchase and confirmation. Tickets are generated per passenger and per journey. The passenger's name and date of birth must be provided. The right to transport is verified by comparing the passenger's name with the booking list. This is preferably done by scanning the ticket.

3.2 Passengers must book before departure. Access to the vehicle is only permitted with a valid booking confirmation.
3.2.1 Trips can be booked via the Transport Phoenix web portal or mobile site. Booking on board is not permitted.

3.2.2 Booking confirmation (order details) is saved and can be viewed on the web portal or sent by e-mail.
3.2.3 Every passenger with a valid ticket is entitled to a seat. Passengers with children and persons with reduced mobility have priority.
3.3 Online ticket purchase:
3.3.1 Product representation on the portal is not a legally binding offer, but a non-binding catalog. By clicking "Book" / "Pay", you place a firm order. The contract is concluded once Transport Phoenix   accepts the order via confirmation email.

3.3.2 Technology cannot guarantee error-free data communication via the Internet at all times.  Transport Phoenix  assumes no liability for the continuous availability of its websites. Online booking might not always be available due to technical reasons.

3.3.3 Legal provisions regarding the right of withdrawal do not apply to distance transport contracts for a specific date, unlike other online mail-order activities. Cancellation terms remain unchanged.
3.4 Transport fares:
3.4.1 Promotional prices may only be partially bookable online.
3.4.2 Fares refer exclusively to the transport of persons; specific items like extra luggage are charged separately.
3.4.3 Reduced rates are subject to specific conditions.

4. INVALID TICKETS


At the request of Transport Phoenix employees during checks, passengers must present their ticket and a valid photo ID.

5. INCREASED TRANSPORT COSTS


5.1 Passengers must pay an increased fare if they have not booked a seat for the journey.
5.2 If a check reveals no valid booking, the passenger must provide correct personal data and identification.
5.3 The increased fare is double the normal price, at least 70 EUR, plus the remaining ticket price. If the route cannot be verified, the starting point of the connection is used.
5.4 Payment must be made within 2 weeks. After this, a 15 EUR processing fee applies.

6. TIMETABLES


6.1 The right to change approved timetables, routes, and prices for valid reasons remains unchanged.
6.3 Schedule changes after contract signature not attributable to the carrier (natural disasters, roadworks) do not entitle to a refund if the difference is less than 2 hours. If more, the passenger may terminate without charge.

7. START OF THE JOURNEY


7.1 Passengers must arrive 15 minutes before departure.
7.2 Failure to appear on time results in loss of transport rights; the seat may be reassigned.
7.4 Identification (ID, passport, visa) may be requested alongside the ticket (paper or PDF).

8. GENERAL PASSENGER OBLIGATIONS


8.1 Passengers must follow instructions from the driver and staff.
8.2 Staff may refuse passengers under the influence of alcohol or narcotics, or those compromising safety. No refund is provided.
8.3 Smoking and e-cigarettes are prohibited on board.
8.5 Cleaning fees of at least 100 EUR apply for intentional or negligent soiling.
8.7 Seat belts are mandatory by law.

9. CHILDREN AND MINORS


9.1 Children aged 0-3 must be in child seats, secured with seat belts, and provided by accompanying adults.

10. DISABLED PASSENGERS OR PERSONS WITH REDUCED MOBILITY


10.1 Currently, our vehicles are not equipped for the transport of persons with reduced mobility.
10.2.3 Service dogs travel for free with valid documentation. They are exempt from muzzle requirements.
10.2.4 The customer service must be informed 48 hours in advance for service dogs.
10.4.1 If vehicle configuration or infrastructure makes boarding physically impossible, we reserve the right to refuse the booking.

11. LUGGAGE TRANSPORT


11.1.1 One free bag (max 80x50x30 cm, 25 kg) is included.
11.1.2 Additional luggage must be booked in advance online or bought from the driver if space is available.
11.2.1 Hand luggage is free (max 42x30x18 cm, 7 kg).
11.3 Special luggage (furniture, electronics) is generally excluded. Bicycles and e-scooters are not permitted.
11.5 Valuables (cash, jewelry, electronics) must be carried in hand luggage under the passenger's care.
11.8  Transport Phoenix assumes no insurance coverage for items forgotten on the bus.

12. ANIMAL TRANSPORT


12.1 Generally, animals are not allowed, except service dogs.

13. PASSENGER RIGHTS


13.1 According to EU Regulation n° 181/2011, rights include non-discrimination, assistance, and rights in case of cancellation or delay.
13.2 Complaints must be submitted in writing within 3 months.  Transport Phoenix  will respond within 1 month. Automatic compensation applies for late responses over 90 days.

14. JURISDICTION


Legal actions must be brought before the court in Ajaccio.

15. SEVERABILITY


If any provision is invalid, the remainder of the contract remains effective.
